01 Operator and Agreement
These Terms govern use of BYONPB, operated by ACE PICKL LLC. By creating an account, using the Service, or affirmatively accepting these Terms where presented, you agree to these Terms and applicable incorporated policies. If you do not agree, do not use the Service. ACE PICKL LLC keeps a record of each acceptance, including the account, the version of the Terms accepted, and the date and time.
02 Adults Only
BYONPB is for persons age 18 and older only. A person under 18 may not create an account or use the Service. ACE PICKL LLC may restrict, suspend, or terminate an account reasonably believed to be used by a person under 18. A user who misrepresents age violates these Terms.
03 Accounts and Deletion
Users must provide accurate information, safeguard credentials, and are responsible for account activity. Users must promptly notify ACE PICKL LLC of any unauthorized use of an account. Users may request account deletion through available in-app controls or designated contact methods. Certain records may be retained where permitted or required for security, fraud prevention, ranking integrity, disputes, legal obligations, or enforcement, as described in the Privacy Policy.
05 Challenges
Challenges may include Singles, Doubles, and Mixed Doubles. An initiator selects a preferred time and may include a court/location. BYONPB may recommend or broadcast Challenges to relevant players using factors such as skill/rating and geographic area. Recommendations do not guarantee identity, compatibility, availability, conduct, safety, or actual playing ability.
06 Doubles / Mixed Partner Selection
An initiator may select a partner without an in-app partner approval step. By selecting a partner, the initiator represents that the partner has given permission to be included and the initiator is responsible for coordinating participation with that partner. Each participant’s play remains subject to that participant’s own acceptance of these Terms and the Participant Assumption of Risk and Liability Waiver through the participant’s account.
07 Scheduling, Changes, Cancellation and No-Shows
Players are responsible for final coordination and schedule changes. Matches may fail to occur due to cancellations, no-shows, weather, court availability, scheduling conflicts, illness, technical issues, or other reasons. BYONPB does not guarantee a match will occur. An unplayed match does not create a competitive score/ranking result.
08 Courts and Locations
A court/location appearing in BYONPB does not mean ACE PICKL LLC/BYONPB owns, operates, has inspected, reserved, authorized, or endorsed it. Users are responsible for confirming legitimacy, availability, permission/authorization, access, fees, facility rules, safety, and suitability before playing.
09 In-Person Interaction and Physical Risk
BYONPB may facilitate meetings between people who do not know each other. BYONPB does not guarantee user identity, background, intentions, conduct, or safety. Pickleball, travel, and facility use involve known and unknown risks including falls, collisions, ball/paddle contact, equipment issues, surfaces, weather, heat or cold, illness, bodily injury, disability, property loss, and misconduct by another person. Participation is voluntary.
10 No Participant Insurance
Unless expressly stated in writing for a specific ACE PICKL LLC program or event, BYONPB does not provide accident, medical, health, property, travel, or liability insurance for ordinary player-arranged matches, public or private Club activities, or third-party-organized activities.
11 Chat and User Content
Users are responsible for communications and content. Threats, harassment, stalking, discrimination, scams, spam, impersonation, unlawful activity, privacy violations, and abusive content are prohibited. BYONPB does not promise continuous monitoring but may review, preserve, restrict, or remove content and take account action for safety, security, enforcement, investigation, or legal compliance.
Users retain ownership of their content. By submitting content, users grant ACE PICKL LLC a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, display, and distribute that content only as reasonably necessary to provide, operate, improve, moderate, and secure the Service, maintain score and ranking integrity, resolve disputes, and comply with legal obligations. Private communications will not be used for advertising or promotional purposes. ACE PICKL LLC will obtain separate permission before using a user’s name, image, likeness, testimonial, or content in external marketing. This license ends when the content is deleted, except for copies reasonably retained for backups, security, disputes, ranking integrity, or legal compliance.
12 Scores and Confirmation
Team A, represented by the Challenge initiator, is responsible for submitting the score. After submission, BYONPB will notify Team B that the score is awaiting confirmation. Team B has 24 hours from the time the score is submitted to confirm or dispute it. If Team B confirms the score, it will be published and processed for ranking. If Team B does not respond within 24 hours, the score will be automatically confirmed, published, and processed for ranking. A disputed score will remain pending and will not affect rankings until the dispute is resolved.
13 Score Disputes
If Team B challenges within the 24-hour period, the score remains disputed and does not affect ranking until both sides agree. If no agreement is reached in an ordinary player-arranged Challenge, BYONPB may close/archive the match as disputed and unranked rather than referee the score disagreement. ACE PICKL LLC may separately investigate fabricated matches, fraud, collusion, or ranking manipulation. Competition rules may give an applicable organizer/tournament director authority to resolve competition disputes.
14 Rankings
BYONPB rankings are platform-generated indicators and are not certifications or guarantees of ability. ACE PICKL LLC may modify methodology and correct, invalidate, recalculate, delay, or remove scores/ratings to address errors, disputes, fraud, manipulation, or methodology changes. When BYONPB invalidates or corrects a published score or ranking, affected users will be notified through the app.
15 Private Clubs and Club Administrators
Private Clubs and other organizations using BYONPB remain independently responsible for their own membership terms, participant waivers/releases where appropriate, facility/court rules, insurance, safety requirements, permissions, programs, lessons, events, fees/refunds, and other Club-specific legal or operational documentation. BYONPB’s Terms or waiver do not replace documentation independently required by a Club. Club administrators represent that they are authorized to manage the Club and must use member information appropriately.
16 Third-Party Tournaments and Competitions
When a Club, tournament director, or other third party uses BYONPB to organize/manage its own tournament, league, ladder, or competition, that organizer remains responsible for tournament/activity operations, participant waivers/releases, insurance, facility permissions, safety, eligibility, rules, officiating/administrative decisions, fees/refunds, and other organizer obligations. ACE PICKL LLC/BYONPB acts as the technology/platform provider unless ACE PICKL LLC expressly identifies itself as the organizer. Organizing or participating in competitions through BYONPB is also subject to the Tournament, League & Competition Terms Framework, which is incorporated into these Terms, and any applicable event-specific terms, rules, and waivers presented for acceptance at registration.
17 BYONPB-Hosted Competitions
When ACE PICKL LLC expressly identifies BYONPB as the organizer of a competition, additional event/competition rules, participant waivers, fee/refund terms, scheduling, safety, conduct, dispute, and organizer provisions may apply and will be presented as appropriate.
18 Distributed, Virtual and Hybrid Competitions
BYONPB may support competitions in which participants coordinate and play matches at different courts, locations, dates, or times during a defined window, as well as hybrid formats combining distributed qualifying play with designated in-person playoffs/finals. For participant-arranged phases, participants remain responsible for location legitimacy, access/permission, safety, scheduling, and facility rules. Applicable competition rules govern scoring, advancement, disputes, forfeits, and organizer authority.
19 Reporting, Blocking and Enforcement
BYONPB may provide reporting/blocking tools and may warn users, restrict features, remove content, invalidate scores, adjust rankings, suspend, or terminate accounts when reasonably necessary to enforce policies, protect users/service, investigate abuse, or comply with law.
20 Scam and Fraud Safety
Users may not use BYONPB to facilitate scams or fraud. Users should not provide other users with passwords, verification codes, banking credentials, gift cards, cryptocurrency, or other sensitive financial credentials in response to suspicious requests.
21 Service Availability and Errors
BYONPB may experience outages, bugs, failed/delayed notifications or messages, scheduling errors, score/ranking errors, data synchronization problems, or other technical issues. The Service is not guaranteed to be uninterrupted or error-free.
23 Paid Subscriptions
If paid subscriptions are offered, the purchase flow will disclose material price, billing period, renewal, cancellation, and other applicable terms. BYONPB paid subscriptions are also governed by the Subscription, Billing, Cancellation & Refund Terms, which are incorporated into these Terms. Paid enrollment requires the user’s express affirmative consent to the disclosed terms before any charge.
24 Intellectual Property
BYONPB software, branding, designs, and original content are owned by ACE PICKL LLC or its licensors. Users receive a limited, revocable, non-transferable right to use the Service as intended. ACE PICKL LLC may use suggestions and feedback that users volunteer, without obligation. Nothing in these Terms prohibits or penalizes a truthful review of the Service.
Copyright Infringement (DMCA). ACE PICKL LLC responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512. A copyright owner or an agent authorized to act on the owner’s behalf may report claimed infringement by sending a written notice to the designated agent: ACE PICKL LLC, Attn: DMCA Designated Agent, 655 Atlanta Rd, Ste 502 #2116, Cumming, GA 30040, Email: Legal@byonpb.com. The notice must include: (a) a physical or electronic signature of the owner or authorized agent; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and information reasonably sufficient to permit ACE PICKL LLC to locate it on the Service; (d) the sender’s name, mailing address, telephone number, and email address; (e) a statement that the sender has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in the notice is accurate and that the sender is the copyright owner or is authorized to act on the owner’s behalf.
Upon receiving a compliant notice, ACE PICKL LLC may remove or disable access to the identified material and will take reasonable steps to notify the user who posted it. That user may submit a counter-notification to the designated agent containing the user’s physical or electronic signature, identification of the removed material and its location before removal, a statement under penalty of perjury that the user has a good-faith belief the material was removed as a result of mistake or misidentification, and the user’s name, address, telephone number, a statement consenting to the jurisdiction of the federal district court for the user’s address (or, for a user outside the United States, the United States District Court for the Northern District of Georgia), and a statement that the user will accept service of process from the person who sent the original notice or that person’s agent. ACE PICKL LLC may restore removed material as 17 U.S.C. § 512(g) provides unless the original sender notifies ACE PICKL LLC that it has filed a court action. ACE PICKL LLC will terminate the accounts of repeat infringers in appropriate circumstances. A person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages under 17 U.S.C. § 512(f).
25 Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” ACE PICKL LLC DOES NOT WARRANT THAT USERS, MATCHES, LOCATIONS, SCORES, RANKINGS, CLUBS, COMPETITIONS, OR THIRD-PARTY SERVICES WILL BE SAFE, ACCURATE, AVAILABLE, ERROR-FREE, OR SUITABLE FOR A PARTICULAR PURPOSE. NON-WAIVABLE RIGHTS REMAIN UNAFFECTED.
26 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACE PICKL LLC AND APPLICABLE AFFILIATES/PERSONNEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES OR FOR LOSSES ARISING FROM USER CONDUCT, PLAYER-ARRANGED MEETINGS, PHYSICAL INJURY, PROPERTY LOSS, THIRD-PARTY FACILITIES, PRIVATE CLUB OPERATIONS, THIRD-PARTY COMPETITIONS, MATCH CANCELLATIONS, SCORE/RANKING DISPUTES, OR SERVICE INTERRUPTIONS, EXCEPT WHERE LIABILITY CANNOT LAWFULLY BE LIMITED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF ACE PICKL LLC AND APPLICABLE AFFILIATES/PERSONNEL FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS THE USER PAID ACE PICKL LLC FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THIS SECTION DOES NOT LIMIT LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
27 Indemnification
To the extent permitted by law, users and applicable organizers agree to indemnify ACE PICKL LLC and applicable affiliates/personnel from claims arising from misuse of BYONPB, user/organizer content or activity, violation of these Terms, or infringement of another person’s rights. ACE PICKL LLC will give prompt notice of any claim subject to this section. This section does not apply to the portion of a claim caused by ACE PICKL LLC’s own gross negligence or willful misconduct. Organizers’ indemnification obligations for their own events are stated in Sections 16 and 17 and the applicable event terms.
28 Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Before filing a claim, the user and ACE PICKL LLC will try to resolve the dispute informally. The user sends a written description of the dispute to the contact in Section 30, and both sides will work in good faith to resolve it within 30 days.
Any dispute that is not resolved informally will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either side may bring an individual claim in small claims court. The arbitration will take place in the user’s home county or by video. ACE PICKL LLC will pay the arbitration fees that the administrator’s rules assign to the company.
TO THE EXTENT PERMITTED BY LAW, ALL CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS AND NOT AS A CLASS OR REPRESENTATIVE ACTION, AND EACH SIDE WAIVES A JURY TRIAL.
A user may opt out of arbitration by sending written notice to the contact in Section 30 within 30 days after first accepting these Terms. This Section does not waive rights that cannot lawfully be waived and does not prevent a report to any government agency. Any claim that is not subject to arbitration must be brought in the state or federal courts located in Forsyth County, Georgia, and both sides consent to venue and jurisdiction there.
29 Changes
ACE PICKL LLC may update these Terms. ACE PICKL LLC will give notice of material changes through the app, by email, or by another reasonable method before the changes take effect, and will require renewed acceptance where legally required. Continued use of the Service after the effective date of a change constitutes acceptance of the updated Terms.
31 General
These Terms, together with the Privacy Policy, the Community and Safety Guidelines, which are incorporated into these Terms, and any other incorporated policies and offer terms, constitute the entire agreement about the Service. If any provision is found unenforceable, the remaining provisions stay in effect, except that if the requirement to bring claims individually is found unenforceable as to a dispute, the arbitration requirement in Section 28 does not apply to that dispute. A failure to enforce a provision is not a waiver. Users may not assign these Terms. ACE PICKL LLC may assign them in connection with a merger, acquisition, or sale of assets. Provisions that by their nature should survive termination survive, including Sections 9, 10, and 24 through 28.
