Waiver
Participant Assumption of Risk & Liability Waiver
Covers ordinary player-arranged BYONPB activity, including distributed matches participants arrange independently. A BYONPB-hosted competition requires separate event-specific terms and an event-specific waiver presented at registration.
01 Adult Eligibility
I confirm that I am at least 18 years old.
02 Voluntary Participation
I understand that BYONPB is a technology platform. I voluntarily decide whether to communicate with, meet, travel to, or play with another user and whether to participate at any location.
03 Assumption of Risk
I understand that pickleball, travel, sports facilities, and meeting other people involve known and unknown risks including falls, collisions, ball/paddle contact, equipment failure, unsafe surfaces, weather, heat, dehydration, illness, bodily injury, disability, property damage/theft, misconduct by another person, and other serious risks, up to and including permanent injury. I knowingly and voluntarily assume all such risks, whether or not listed above.
04 No Verification or Supervision
Unless expressly stated for a specific ACE PICKL LLC program/event, BYONPB does not perform background checks, supervise ordinary player-arranged matches, provide referees, inspect courts, verify location safety/authorization, guarantee user identity/conduct, or provide medical supervision.
05 Locations
A location may be supplied by another user or third party. I am responsible for independently determining whether it is legitimate, safe, available, authorized, and appropriate and for complying with facility rules.
06 No Participant Insurance
BYONPB does not provide accident, medical, health, property, travel, or liability insurance for ordinary player-arranged matches unless expressly stated otherwise.
07 Personal Responsibility
I am responsible for my conduct, safety decisions, physical readiness, equipment, transportation, belongings, scheduling, and choice of players and locations.
08 Private Clubs, Third-Party Activities, and BYONPB-Hosted Events
I understand that private Clubs and third-party organizers using BYONPB may impose their own terms, rules, waivers, releases, insurance requirements, and facility/activity conditions. BYONPB's waiver does not replace documentation independently required by those organizations. A BYONPB-hosted competition requires my separate acceptance of event-specific terms and an event-specific waiver at registration, and this Waiver continues to apply to distributed matches I arrange independently. 09 Release and Waiver
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, I RELEASE, WAIVE, AND DISCHARGE ACE PICKL LLC, BYONPB, AND THEIR RESPECTIVE OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS (THE “RELEASED PARTIES”) FROM ALL CLAIMS, LIABILITIES, DAMAGES, AND CAUSES OF ACTION ARISING FROM MY VOLUNTARY PARTICIPATION IN PLAYER-ARRANGED ACTIVITIES OR MY INTERACTIONS WITH OTHER USERS, INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF A RELEASED PARTY. I AGREE NOT TO SUE ANY RELEASED PARTY FOR A RELEASED CLAIM. THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, WILLFUL OR WANTON MISCONDUCT, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE RELEASED OR WAIVED, AND IT DOES NOT RELEASE ANY PERSON OTHER THAN THE RELEASED PARTIES, INCLUDING OTHER USERS.
10 Governing Law, Disputes, and Severability
This Waiver is governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Disputes relating to this Waiver are resolved as provided in the BYONPB Terms of Service, including its arbitration and dispute-resolution provisions. If any part of this Waiver is found unenforceable, the remaining parts stay in effect, and the unenforceable part is enforced to the maximum extent the law allows. This Waiver works together with the Terms of Service and does not limit rights that cannot lawfully be waived.
11 Electronic Acceptance
I accept this Waiver by an affirmative electronic action presented before my first Challenge. ACE PICKL LLC records each acceptance with my account, the waiver version, the date and time, and the app version, and archives each published version of this Waiver. A material change to this Waiver requires my renewed acceptance.

I HAVE READ THIS WAIVER, I UNDERSTAND THAT IT GIVES UP LEGAL RIGHTS INCLUDING THE RIGHT TO SUE THE RELEASED PARTIES FOR ORDINARY NEGLIGENCE, AND I AGREE TO IT FREELY AND VOLUNTARILY.
